Welcome to TrainerPay, operated by T.H.E. DOJO LLC. By using the service, you agree to these terms. Please read them — they're short on purpose.
TrainerPay is a booking and payment tool that connects personal trainers with their clients. We provide the software; trainers provide the training. We are not a gym, a trainer certification body, or a party to any training session.
You must be at least 18 years old to create an account. By signing up, you represent that you are. Trainers are responsible for complying with any licensing, certification, or local regulations that apply to their services.
Trainers who use TrainerPay are independent contractors, not employees, agents, or representatives of T.H.E. DOJO LLC. TrainerPay does not control, supervise, or direct the training services that trainers provide. Any contract for services is between the trainer and their client — not with us.
TrainerPay is not responsible for, and cannot resolve, disputes between trainers and clients. This includes, without limitation: cancellations, no-shows, refunds, quality of training, injuries, scheduling conflicts, or payment disagreements. We encourage trainers and clients to communicate directly and in good faith.
If a dispute involves a payment processed through Square, you may also pursue resolution through Square's dispute process.
You're responsible for keeping your login credentials secure and for everything that happens under your account. If you notice unauthorized access, tell us immediately at support@trainerpay.com.
Don't use TrainerPay to do anything illegal, harmful, or abusive. Specifically, don't: misrepresent your credentials, harass other users, upload malicious content, attempt to break or abuse the platform, or use it for services that violate applicable law. We can suspend or terminate accounts that do.
You can delete your account anytime from Settings or by emailing us. We can suspend or terminate accounts that violate these terms, abuse the platform, or engage in fraud. If we terminate your account for cause, no refunds of unearned platform fees are owed.
TrainerPay is provided "as is" without warranties of any kind. We work hard to keep it running, but we can't guarantee uninterrupted service, error-free operation, or that it will meet every need.
To the maximum extent permitted by law, T.H.E. DOJO LLC is not liable for indirect, incidental, or consequential damages arising from your use of TrainerPay. Our total liability for any direct claim is limited to the greater of (a) the platform fees you paid us in the 12 months before the claim, or (b) $100.
We may update these terms occasionally. If the changes are material, we'll notify you by email or in-app. Continued use after changes take effect means you accept the updated terms.
These terms are governed by the laws of the State of California, excluding its conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in California.
